  1. Introduction

1.1 Task Helper Limited is committed to protecting the privacy of all Customers, Helpers, and other individuals that interact with us, whether through the Platform, our website, or communications, transactions or other dealings.

1.2 We collect and store Personal Information about you to allow us to provide you with our platform and services. Our collection of Personal Information is subject to the New Zealand Privacy Act 2020 and all regulations and subordinate legislation implemented under it (Act). This privacy policy (Policy) explains how we may collect, use, disclose and protect your Personal Information in accordance with our obligations under the Act.

1.3 Nothing in this Policy alters your rights under the Act. If you would like to learn more about these rights, please visit www.privacy.org.nz.

  1. Definitions

2.1 In this Policy, the following terms have the following meanings:

Customer means a registered user of the Platform who posts Tasks for Helpers to complete.

Helper means a person registered on the Platform who has been approved by Task Helper to perform Tasks for Customers as an independent contractor.

Payment Processor means Stripe New Zealand Limited (5639473).

Personal Information means information about an identifiable individual.

Platform means the online marketplace operated by Task Helper that enables Customers to post Tasks and Helpers to view, accept, and perform those Tasks.

Platform Rules means the operational rules published by us on the Platform website, as amended from time to time in accordance with those rules.

Purpose has the meaning given in clause 3.1.

Task means a job or service listed by a Customer on the Platform for a Helper to perform for payment through the Platform, including (without limitation) cleaning, gardening, moving assistance, and minor maintenance, but excluding any personal arrangement not transacted through the Platform.

Task Helper, we, us, our means Task Helper Limited (9416066).

You (and your) means you, the reader of this Policy. Depending on the context, you may be reading this Policy as a Customer, a Helper, or another individual interacting with us, and references to “you” should be read accordingly.

Vetting Agency means the third-party criminal conviction history check provider nominated by Task Helper from time to time (currently National Crime Check Pty Limited ABN 60 139 183 145).

  1. Why we collect your Personal Information

3.1 We may collect and use your Personal Information for the following purposes:

  1. To verify your identity.

  2. To make the Platform available to you.

  3. To communicate with you (including for marketing and Platform notification purposes) and respond to communications from you.

  4. To improve the Platform that we provide to you.

  5. To conduct background vetting of Helpers.

  6. To share Task details and related necessary Customer details with the assigned Helper for the purpose of Task completion.

  7. To enable live tracking during Task performance and facilitate in-app communications between Helpers and Customers.

  8. To collect and retain photographic evidence, written statements, and other materials submitted by Helpers or Customers during the dispute resolution process.

  9. To process payments and payouts through the Payment Processor.

  10. To facilitate dispute resolution and complaints in relation to the completion of Tasks.

  11. To protect and/or enforce our legal rights and interests, including defending any claim.

  12. For any other purposes authorised by you or the Act.

(Purposes).

3.2 We only collect and use your Personal Information for reasons associated with the above Purposes.

  1. Your agreement to our collection of your Personal Information

4.1 By using our Platform or otherwise engaging with us, you agree to your Personal Information being collected, held and used in accordance with this Policy.

4.2 The Platform is not intended for use by persons under the age of 18. We do not knowingly collect Personal Information from children under the age of 18. If we become aware that we have collected Personal Information from a person under 18, we will take steps to delete that information.

  1. Types of Personal Information we may collect

5.1 The Personal Information that we will collect about you depends on the Purpose for which it is collected, the context of our interaction, and the means via which that interaction occurs.

5.2 Examples of Personal Information that we may collect:

Customer registered with the Platform
• Name.
• Contact details (email address and phone number).
• Residential address and/or other address at which Tasks are to be completed (which is shared with the assigned Helper for Task completion).
• Task booking history and any instructions or supplementary information provided for Task completion.
• Ratings or feedback provided about Helpers.
• In-app chat communications with Helpers and our support team.
• Location and device data collected through the website or mobile application (including GPS data during live tracking of active Tasks).

Helper registered with the Platform
• Name.
• Contact details (email address and phone number).
• Residential address.
• Criminal conviction history results (obtained via the Vetting Agency from the Ministry of Justice).
• Task completion history and ratings received from Customers.
• In-app chat communications with Customers and our support team.
• Professional qualifications or profile information (including any images) voluntarily provided.
• Location and device data collected through the website or mobile application (including GPS data during live tracking of active Tasks and background location data used to allocate Task Listings within the Helper’s geographic radius).

Visitor to our website
• IP address.
• Device and browser information.
• Location data.
• Cookies.

Enquirer contacting us via phone or email
• Name.
• Email address and/or phone number (as the context requires).
• Content of enquiry or correspondence.

General compliance matters
Other information we are required to collect to meet a legal, regulatory or compliance obligation (where applicable).

5.3 More detailed information about why we collect the Personal Information outlined above is available upon request.

5.4 Where a Task Complaint is raised, we may collect and retain photographic evidence of Task completion, written submissions from the Helper and/or Customer, and any other materials provided in connection with the dispute, for the purposes of investigating and resolving the complaint.

  1. Third party collection of Personal Information

6.1 Third parties nominated by us will collect your Personal Information to undertake criminal conviction checks and to process payments and payouts.

6.2 Examples of Personal Information that they may collect:

• Name.
• Contact details.
• Payment method, card number, cvc, expiration date, billing address and/or account number.

Vetting agency collecting helper information
• Name.
• Contact details.
• Identity verification documents (government-issued identification).
• Residential address.

  1. How we collect your Personal Information

7.1 We may collect your Personal Information directly from you, from third parties, or from other sources where the information is publicly available.

7.2 Where practicable in the circumstances, we will collect Personal Information directly from you.

7.3 Where it is impracticable in the circumstances to collect Personal Information directly from you, or where we have reasonable grounds to believe that an exception to Information Privacy Principle 2 applies, we may collect your Personal Information from a source other than you. The primary circumstances in which we indirectly collect Personal Information are described below.

7.4 In relation to criminal conviction history data specifically, we collect this information on the basis of the Helper’s express informed written consent, provided during the onboarding process in accordance with the Helper Agreement. This consent authorises us to request the Helper’s criminal conviction history through the Vetting Agency and to hold the results for the purposes of initial and ongoing vetting.

Criminal conviction history checks (Helpers)
As part of our Helper onboarding process, we require mandatory criminal conviction history checks to be conducted via the Vetting Agency, an intermediary that is registered with the Ministry of Justice. The Vetting Agency’s platform is integrated into our onboarding process via a white-labelled API, meaning that when you complete the vetting process it will appear to remain within the Task Helper experience. However, the following should be noted:
• The Vetting Agency is a separate entity (based in Australia) that collects your written consent, Personal Information (including your full name, date of birth, contact details, and government-issued identity documents) directly from you through its platform for the purposes of conducting the criminal conviction history check and identity verification upon our request.
• The Vetting Agency processes the criminal conviction history request through the MoJ and then subsequently discloses the results of those services to us.
The Vetting Agency that we currently use is called National Crime Check Pty Limited, a company incorporated in Australia with ACN 139 183 145 and registered office of PO Box 10091, Adelaide BC, SA 5000. We encourage you to also independently review National Crime Check Pty Limited’s privacy policy available at https://nationalcrimecheck.nz/privacy-policy.

General legal compliance
From time to time, a legal or regulatory obligation may require us to collect Personal Information about you from third-party sources.

7.5 Where we collect your Personal Information directly or indirectly:

  1. that collection will only occur as necessary to further any of the Purposes;

  2. the Personal Information will be held by us and will only be disclosed to third parties in accordance with clause 8; and

  3. you have the rights to access to and the correction of the Personal Information that we hold about you, as further detailed in clause 15.

  4. Who we may disclose your Personal Information to

8.1 We may disclose your Personal Information to:

  1. Any business that supports our Platform and services, including any person that hosts or maintains any underlying IT system or data centre that we use to provide the Platform or any of our other services, and customer support partners.

  2. The Vetting Agency, for the purposes of conducting criminal conviction history checks and identity verification of Helpers.

  3. The Payment Processor, for the purposes of processing pre-authorised Customer payments and payouts to Helpers.

  4. Where you are a Customer, assigned Helpers, who will receive the address at which the Task is to be completed, Task details, and any instructions or supplementary information provided by you for the purpose of Task completion.

  5. Where you are a Helper, Customers, who will receive profile information about you (such as first name, profile photo, and ratings) for the purposes of the Task matching and booking process.

  6. Any person who can require us to supply your Personal Information (such as a regulatory or government authority), any other person authorised by the Act or another law (such as a law enforcement agency), or any other person authorised by you.

8.2 We may disclose or store your Personal Information with service providers or other recipients located outside New Zealand. In particular, Helpers should be aware that the Vetting Agency is domiciled in Australia, and that Personal Information provided as part of the criminal conviction history check process will be disclosed to and processed by the Vetting Agency in Australia. Helpers expressly authorise this overseas disclosure by consenting to the criminal conviction history check as part of the onboarding process.

8.3 We may also disclose your Personal Information to any entity that we enter into any joint venture with or any other business that we are sold to or merged with.

8.4 We will only disclose Personal Information to the parties listed in this clause 8 if it is necessary and appropriate to facilitate the Purposes for which your Personal Information was collected.

  1. Direct marketing

9.1 In accordance with the Purposes, we may use your Personal Information to directly market our services to you. The nature of our marketing to you may vary depending on whether you are a Customer or Helper (for example, Customers may receive Task recommendations, and Helpers may receive notifications about available Tasks). We may carry out this direct marketing by online advertising, email, phone, or in-Platform notices.

9.2 You have the right to revoke your agreement to receive direct marketing at any time by contacting us, adjusting your notification preferences within the Platform, or by selecting “unsubscribe” in the relevant communication.

  1. Cookies and analytics

10.1 Our website and Platform use cookies and similar technologies. We use the following types of cookies:

  1. Essential cookies: These are necessary for the Platform to function correctly and cannot be disabled. They include session cookies and authentication cookies.

  2. Analytics cookies: These help us understand how users interact with the Platform and improve our services. You may opt out of analytics cookies through your browser settings or Platform preferences.

10.2 You can manage your cookie preferences through your browser settings. Disabling essential cookies may affect Platform functionality.

  1. In-app communications and live tracking

11.1 Our Platform includes an in-app chat feature that enables direct communication between matched Customers and Helpers. In-app chat messages may contain Personal Information and will be retained for the purposes of dispute resolution, quality assurance, and Platform safety.

11.2 All communications between matched Customers and Helpers must occur through the Platform’s in-app messaging system which is not a public forum. Helpers and Customers must not exchange personal contact details (such as phone numbers, email addresses, or social media profiles) through the Platform. Any Personal Information voluntarily disclosed by a party in breach of this requirement is disclosed at that party’s own risk, and Task Helper accepts no responsibility for any misuse of such information by the other party beyond our stated retention and security practices.

11.3 We collect location data (including GPS coordinates) of Helpers in two contexts: (a) to allocate Task Listings to Helpers within a defined geographic radius (background location data, collected when the Helper is logged into the Platform and has location services enabled); and (b) during active Task performance, to enable the Customer to monitor Task progress (live tracking data). The Customer’s live tracking view is available only during active Tasks.

11.4 Helpers may disable location services at any time through their device settings or Platform preferences, but acknowledge that doing so may prevent them from receiving Task Listing notifications or accepting Tasks.

  1. How long we will store your Personal Information

12.1 We will ensure that your Personal Information is not retained for longer than is necessary to fulfil:

  1. the Purpose that it was collected; and

  2. any legal or regulatory requirements applicable to the retention of that Personal Information.

12.2 Once there is no longer a basis to hold information pursuant to clause 12.1, that information will be securely deleted or de-identified.

12.3 Without limiting the generality of the above, the following specific retention periods apply:

  1. Criminal conviction history data: retained for the duration of the Helper’s active relationship with the Platform plus 12 months after offboarding, followed by secure disposal.

  2. Identity verification documents: retained for the period required under our agreement with the Vetting Agency.

  3. In-app chat data: retained for 12 months following the date of the relevant communication, for dispute resolution and quality assurance purposes, followed by secure disposal.

  4. Live tracking/GPS data: live tracking data retained for the duration of the Task; background location data (used for Task allocation) retained for 7 days.

  5. Dispute-related evidence (photographic proof, written statements): retained for 12 months following resolution of the relevant complaint, followed by secure disposal.

  6. How we protect your Personal Information

13.1 We take all reasonable steps to keep your Personal Information safe from loss, unauthorised activity or other misuse. These steps include:

  1. Adopting and regularly reviewing the performance and terms of our internal data security policies and systems to ensure that they are fit for purpose and protect your Personal Information from unlawful processing, accidental loss, destruction and damage; and

  2. Adopting technologies for our internal use that otherwise help us to comply with the Information Privacy Principles set out in the Act.

13.2 All payments on the Platform are processed through the Payment Processor. Customer payment is pre-authorised at the time of booking via the Payment Processor and released to the Helper following expiry of the 24-hour complaint window (as described in the Helper Agreement and Platform Rules), subject to no valid complaint being raised. Where a complaint is raised, the pre-authorised payment may be held until the complaint is resolved. We do not store your payment details. 13.3 Where we disclose Personal Information in accordance with clause 8, we will take reasonable steps to ensure that the recipient has appropriate data security policies and systems in place prior to disclosure. Where Personal Information is disclosed outside of New Zealand in accordance with clause 8.2, we will ensure that the recipient is subject to privacy safeguards that are comparable to those required under the Act (or that the disclosure is otherwise permitted by the Act).

  1. Privacy breaches

14.1 If we become aware of a privacy breach involving your Personal Information, we will:

  1. assess the breach to determine whether it amounts to a notifiable privacy breach (as that phrase is defined in the Act);

  2. investigate the cause and effects of the breach; and

  3. take reasonable steps to prevent similar breaches from occurring again in the future.

14.2 Where the breach is assessed as being a notifiable privacy breach (that is, it is likely to cause serious harm), we will notify the Privacy Commissioner and (subject to any appropriate exceptions applying) the affected individuals of the breach in accordance with the requirements of the Act.

  1. Your rights to access to and correction of your Personal Information

15.1 Under the Act, you have the following rights:

  1. The right to be informed about how your data is being used. If you would like further information beyond that provided in this Policy, please contact us.

  2. The right to access readily retrievable Personal Information held by us about you. This right is subject to certain grounds for our refusal as outlined in the Act.

  3. The right to request corrections to the Personal Information that we hold about you. Should you request a correction, we will make the correction should the correction be reasonable and we are reasonably able to make it. If we are unable to, we will take reasonable steps to note the requested correction in our records against your data.

15.2 If you would like to exercise the above rights, please contact our Privacy Officer using the details set out in clause 17. In your message, please clearly state what information you are requesting, provide evidence of your identity, and notify us of anything else you deem relevant to your request. Please note that, in considering your request, we may need to request additional information from you in order to verify your identity prior to acting on your request.

15.3 You may request deletion of your account and associated Personal Information by contacting our Privacy Officer. Upon receiving a valid deletion request, we will delete or de-identify your Personal Information within a reasonable timeframe, except to the extent that we are required or permitted to retain certain information by law (for example, criminal conviction history data during the applicable retention period under clause 12.3, and any records required for tax or legal compliance purposes). We will inform you of any information that we are unable to delete and the reasons for its retention.

  1. Changes to this policy

16.1 Please note that we may make changes to this Policy at any time by uploading a revised Policy onto our website. Any changes will be effective from the date that the revised Policy is uploaded. We encourage you to review the Policy regularly for the latest information on our privacy practices.

16.2 Where we make material changes to this Policy, we will notify you through the Platform or by other appropriate means and re-obtain your acceptance to the updated Policy in accordance with clause 4.1.

16.3 Where we make material changes to this Policy that are necessitated by expansion of the Platform’s operations to jurisdictions outside New Zealand, we will update this Policy to reflect the applicable privacy laws of those jurisdictions (including, where relevant, the Australian Privacy Principles under the Privacy Act 1988 (Cth)).

18.1 If you are unhappy with how we have handled any privacy issues you have experienced or otherwise feel that we have breached your privacy, you are entitled to submit a complaint to the Office of the Privacy Commissioner. More information about this process can be found here.

18.2 Complaints can be submitted to the Office of the Privacy Commissioner via any of the following means:

  1. by completing the online Complaints Form; or

  2. by calling the Office of the Privacy Commissioner at 0800 803 909.
